Terms of Service for poppop ai

The full agreement

1. Acceptance

   By opening an account, sending a message or completing a payment on poppop ai you agree to these terms. If you do not agree with any part of them, do not use the service.

2. Definitions

   "Service" means the poppop ai website and companion chat. "Member" means a registered user. "Companion" means a generated character. "Content" means text, images and audio exchanged inside the Service.

3. Age requirement

   Membership is limited to people aged 18 or over, or the higher age of majority where you live. By registering you confirm you meet that requirement, and we may close accounts where we have reason to doubt it.

4. Nature of the Service

   poppop ai provides entertainment and companionship-style conversation. Companions are fictional characters, not real individuals, and any resemblance to a real person is unintentional.

5. Not professional advice

   Conversations are not medical, psychological, legal or financial advice. In an emergency or crisis contact qualified local services rather than a companion.

6. Account registration

   You must give a valid email address and keep your details current. One person may hold one account unless we agree otherwise in writing.

7. Account security

   You are responsible for your password and for everything done through your account. Tell us promptly if you suspect unauthorised access.

8. No sharing or transfer

   Accounts, subscriptions and message balances are personal. They may not be sold, shared, gifted or transferred to anyone else.

9. Free tier

   The free tier includes a daily allowance of messages and access to the companion gallery. Allowances may change as the Service develops, and no free feature is guaranteed permanently.

10. Subscriptions

    Paid plans unlock unlimited messages and additional features for the period you select. Prices, inclusions and taxes are shown before you confirm a purchase.

11. Automatic renewal

    Subscriptions renew automatically at the end of each period at the price then displayed, unless you cancel before the renewal date.

12. Cancellation

    You may cancel at any time from your account settings. Cancellation stops the next renewal and leaves access in place until the current period ends.

13. Refunds

    Unused, unopened subscription periods may be refunded within 14 days of purchase where the law of your country provides that right. Consumed message allowances and delivered media are not refundable.

14. Chargebacks

    Raising a chargeback without first contacting support may lead to suspension while the claim is examined. We will always try to resolve billing issues directly and quickly.

15. Price changes

    We may change prices for future periods. Existing subscribers are notified at least 14 days before a change applies and can cancel before it takes effect.

16. Acceptable use

    Use the Service lawfully and respectfully. Do not attempt to make a companion produce content involving minors, non-consent, violence against real people, or anything illegal in your jurisdiction.

17. Prohibited technical conduct

    You may not scrape the Service, resell access, reverse engineer it, bypass rate limits, automate accounts, or interfere with its availability for other members.

18. Impersonation

    Do not configure a companion to imitate a real identifiable person, and do not upload another person's likeness or private information without their permission.

19. Your content

    You keep the rights to the text you write. You grant us a limited licence to store and process it solely to operate the Service, including keeping conversation memory for you.

20. Generated content

    Media generated for you may be used for personal, non-commercial enjoyment. Commercial redistribution, resale or republication as your own work is not permitted.

21. Our intellectual property

    The poppop ai name, wordmark, interface, design, copy and companion catalogue are protected. Nothing in these terms transfers ownership of them to you.

22. Feedback

    Suggestions you send us may be used without obligation or payment. We will never publish your name alongside feedback without asking first.

23. Availability

    We aim for continuous availability but do not guarantee it. Maintenance, updates, provider incidents or force majeure may interrupt the Service without notice.

24. Changes to features

    Features may be added, altered or withdrawn as the Service evolves. If a paid feature is withdrawn permanently we offer a pro-rata credit or refund for the affected period.

25. Moderation and enforcement

    We may review reports, restrict features, remove content or suspend accounts that breach these terms. Serious or repeated breaches lead to permanent closure without refund.

26. Suspension and termination

    You may stop using the Service at any time. We may terminate an account for a material breach of these terms, for suspected fraud, or where required by law.

27. Disclaimer of warranties

    The Service is provided "as is" and "as available". To the extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

28. Limitation of liability

    To the maximum extent permitted by law our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect or consequential loss.

29. Indemnity

    You agree to cover reasonable losses we incur as a result of your unlawful use of the Service or your breach of these terms, where those losses are caused by your conduct.

30. Third-party services

    Payment processing, hosting and email delivery are provided by third parties under their own terms. We choose them carefully but do not control their operations.

31. Privacy

    Personal data is handled as described in our Privacy Policy, which forms part of this agreement. Please read it before creating an account.

32. Communications

    We may send service messages about billing, security and important changes. These are part of the Service and are not marketing, so they cannot be switched off while your account is open.

33. Governing law and disputes

    These terms are governed by the laws of the operator's place of establishment, without affecting mandatory consumer protections in your country of residence. Disputes go to the competent courts there.

34. Severability and assignment

    If a clause is held unenforceable the rest remains in force. We may assign this agreement as part of a reorganisation or sale of the business; your rights stay the same.

35. Entire agreement and changes

    These terms, together with the Privacy Policy, are the whole agreement between us. Updates are published on this page with a new date, and continued use after that date means acceptance.
